Evictions for Renovations
Tenants across British Columbia have been affected by evictions for renovations (“renovictions”) in the last few years due to rising property values and a lack of new units of rental housing. TRAC believes that BC should amend the Residential Tenancy Act to follow the Ontario Residential Tenancies Act that allows tenants of units that have been renovated to move back in at the same rent under the same tenancy agreement. Two tenant groups in Vancouver that work to prevent evictions for renovations are:
• Renters at Risk
• West End Residents Association
Some court decisions regarding renovictions include:
• Allman v. Amacon Property Management Services Inc., 2007 BCCA 141
• Berry and Kloet v British Columbia (Residential Tenancy Act, Arbitrator) 2007 BCSC 257
